These Terms & Conditions (T&C) document the end users’ (hereinafter referred to as you/ user) access to and use of ‘Itisaras Platform’ which shall include the website itisaras.org and any/ all other accounts on Social Media, and shall be accessible through a computer, mobile or any other internet connected device(s) or any other means thereof.
ITISARAS is a Non-Government Organization, working in the field of Legal Literacy and Governance with its office at_. Through its various platforms including but not limited to the domain website and social media accounts, ITISARAS provides you literary articles, interviews and opinions on the topics of Culture, History, Polity and Society and any other humanitarian aspect.
The T&C along with the privacy policy constitute a legally binding agreement between the user and Itisaras regarding the user’s access to and use of the services offered including but not limited to delivery of content via the website. By clicking “I agree”, the user agrees to be bound by these T&Cs. The user hereby represent that he/she are at least 18 years of age and capable of entering, performing and adhering to these T&Cs and that the user agrees to be bound by the following terms and conditions. If the user is an individual below 18 years of age, he/ she may utilize the services of Itisaras Platform, subject to receipt of consent and guidance from the parents/guardian’s registered account only. The user shall agree to register prior to uploading any content and/ or comment on Itisaras Platform and provide the details required/ if any.
- Changes to Itisaras Platform
ITISARAS reserves the right to suspend/ cancel or discontinue all or any part of the Services at any time, make modifications and alterations in any or all of the content and Services contained on its platform, without prior notice.
- Intellectual Property Rights
- Unless stated otherwise, all rights (inclusive of but not limited to intellectual property rights), title and interest in and to all material presented on Itisaras Platform (inclusive of but not limited to trademarks, copyrights, wordmarks, logos, information, data, text, software, video, sound, photographs, graphics, messages (hereinafter colly. referred to as “Content”)) are and shall continue to remain the sole and exclusive property of ITISARAS, in perpetuity and are protected under all applicable laws to the fullest extent.
- The user shall agree not to use any framing techniques to enclose any trademark or logo or any other proprietary information of the Platform; or remove, conceal or obliterate any copyright or other proprietary notice. Any infringement shall be defended by the NGO and pursued to the fullest extent as per the due provisions of the applicable laws.
- Content posted/ transmitted to/ at Itisaras Platform
- That any Content transmitted/ posted through or on Itisaras Platform, is the sole responsibility of the associates of the Organisation running the Platform. The user shall agree to not post or upload any information or material which is harmful, obscene, defamatory, pornographic, libelous, invasive of another’s privacy, profane, hateful, contemptuous, or racially, ethnically objectionable or otherwise unlawful in any manner and that the user posting such material will be solely liable for any actions taken against him.
- Itisaras Platform accepts no responsibility for such content. However, any content posted on the Platform by the associates of the Organisation is the intellectual property of the Organisation.
- No unlawful or prohibited use
The user shall agree to not use the services offered on Itisaras Platform for any purpose that is unlawful or prohibited by these T&Cs. The user shall not use the Services in any manner that could damage, disable, overburden, or impair the server of the Platform or interfere with any other party’s use and enjoyment of the services through hacking or any other means.
By agreeing to these T&Cs the user is forbidden from publishing any material provided by Itisaras on any other media, selling, sublicensing and/ or otherwise commercializing any website material, engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this website.
- Limitation of Liability
In no event, ITISARAS, or any of its members, or associates, or Founding Members, shall be held liable for any indirect, consequential or special liability, arising out of, or in any way connected with the use of the said website.
- Indemnification
The user hereby indemnifies to full extent the Organisation name from and against any/ all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the mentioned terms and conditions.
- Severability
If any provision of these T&Cs is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions therein.
- Variation of Terms
ITISARAS reserves the right to revise the terms of agreement at any time as it seems fit and is allowed to assign, transfer, and subcontract its rights and/ or obligations under these terms without any notification. The user accessing the platform to avail the services is expected to review the terms and conditions on a regular basis.
- Entire Agreement
These terms and conditions constitute an agreement between the user and the Organisation in relation to Itisaras Platform and overrides any/ all prior agreements and understandings.
- Governing Law & Jurisdiction
These T&Cs will be governed by and interpreted in accordance with the laws prevailing in the Country of India,
